A fatal accident occurred in Greens boro yesterday Afternoon at 4 o'clock when a street sprinkler filled with water ran over and mortally Injured a small negro boy Enamed Keck. The accident occurred in front of the 9. M. Maddox & Co. drug store, where th small victim was employed. It seemc I that the wagons stop in front of tht Istore to fill the tank with water and the boy had formed a habit of swing ing on and off of the sprinkler. Yes terday afternoon he made his last awing. He jumped on the wagon and started to get down by the driver. The wagon started off; the boy agalr leaped to get on; fell and the bit wheels of the vehicle passed over his body. The boy, however, got to hi: feet and walked into the store and a first It was thought that he was un injured. However, he sank to thi floor and died within a. few, second: after entering the store. Day before yesterday X. B. Lange was prosecuted in police court on the charge of retailing, whiskey. Ed. Moore, the prosecuting witness, testi fied that he had bought whiskey from the defendant but that the last purchase was made in August, 1909. on that testimony Lange was found not guilty, Hie act being barred by the statute of limitations. That would seem to end the matter, but Moore also testified that he had made the name statement to the grand jury during the criminal term of Superior court in May. That statement brought up two questions: if Moore made that state ment to the grand jury, was there a presentment made against Lange? and if such presentment was made, would it still be valid and could Lange i 9 prosecuted In the case in Superior "i.urt? When asked about its validity. Col. Lusk stated that it would be good for all time, since the action was taken before the statute of limitations be came operative; that the case In po lice court would be considered as a nol prosse, because this court would oncerning the facts in the case and have no Jurisdiction In the matter if it Is found that a presentment was made and turned over to the clerk of the court. This was done at the May term, and at the July term the presentment was looked for, in order to bring the case up, but could not be found, probably having been lost. Search has since been made for lt also, but it has never been found. Col. He also stated that the action was brought In the lower court because the presentment was apparently lost and it was hoped that a conviction could be procured there.
