A rumor waa put into circulation through the prose a day or two bum that the Erie Company had become entangled In legal mattera in the West which would probably eauae sere re lose to this corporation. Thia induced many mall speculator to sell at a decline. It now appears that these nnfarorable reports were inrented purposely by the bull clique, who suddenly sprung their mine. Thia a. v. they ran up the price here from 68 to G2 within an hour amid considerable excitement in the Btook Exchange. The holders of Erie aharea are loaning out their stock thia a. m. to persons who are ahort at cent per day or $50 per diem for the use of each 100 share certifi cate. Precisely who are the persona that suffer by this comer ia not yet , developed, but it ia rumored that Jay Qonld is one of the unfortunate. lath. " It is ascertained liat the corner In the Erie aharea waa engineered by Daniel Drew and that Jay Gould has no interest in the present moremeut. Noticing that the German tankers were free sellers yesterday, probably expecting to be able to make good their delivery to-day, Mr. Drew, it ia ' said, quietly bought the stock offered, amounting to ten thousand aharea. Unfortunately for the sellers they will not be able to produce tbeir stock till the arrival of the next Liverpool steam er, and in the meantime Mr. Drew re fuses to loan a share for lees than 1 per cent per day. The latest loaning rate was I per sent. The mice of stock waa 621 in the regular way and C3, cash. The suspension of the Brooklyn , . Trust Company was a great surprise to Wall street, and caused a temporary depression of the stock. The ex-money brokers were ia the Libit of borrow ing money from the concern, and not one of them even suspected that any thing waa wrong. The capital assets amounted to $500,000, the snrplus $100,000, and the deposits $2,200,000, Mr. Mills, the late President, is a de faulter to the extent of $146,000. He left $150,000 of Wilbmantio and Air Line CapUat Kailroad bonds wliith have some value, but not enough to cover the amount of cash taken. Mr. Chauncery, one of the directors, has been trying for a long time past to get an examination of the Company, but the directors generally objected as it would reflect on Mr. Mills. At last he obtained the consent of five of the directors and a requisite number for the examination of land, and as soon aa Mr. Mills found thia out he com mitted suicide. D. Chauucey has been appointed HaWver of the Brooklyn Trust Com pany. Borne of the Directors state that the deposits will ba paid in full and probably something left for the stock holders. CUBA. In the tranamission of the Alabama in demnity fund of $13,500,000 to the United State, the English Govern ment availed itself of three American banking houses in London, J. 8. Mor gan A Co. Morton, Rose A Co., and Jay Cooks, MoCulloch A Co. The bankers determined to transmit about one-fourth through the ordinary chan nels of exchange. Accordingly, Mor gan A Co., have drawn billa for about $9,000,000 on London houses and aold them, that amount being placed to the eredit of England on thia aide; It ia not the intention of the bankera to transmit any additional aum in thia way, but the balance ia to be sent over through shipments of 6-20 bonds to the amount of $7,500,000,. a considera ble portion of which Laa already been obtained. The transaction in exchwge was managed quietly at the instance of the Chancellor of Exchange, who waa afraid of the effect its publicity might haveon the market. The bonds will be turned into gold at par, making the full amount of the indemnity. Madrid, July 19. As it is a matter in which a great deal of inter est is felt by our people, we give be low an outline of the argument pro and con. Our readers have alread been .-in formed of the fact that the case came np upon an appeal by the defendants from the decision of Jndge Albertson sustaining an injunction granted by Judge Watts, restraining them from altering the gnRge of the North Caro lina Railroad from Greensboro to Charlotte. It seems that the discus sion was not confined to the question as to the alteration of the guage, but the legality of the present lease under which the Kichmond Danville itaii road holds MRsession of the North Carolina lUuroad was argued. The Btnte contended that the leaae was invalid ; that no north Carolina Railroad had power, nnder its charter, to make such a lease as this, and in the next place that the Richmond It Dan ville Railroad could not take the lease. That it was against the publio policy of the State for corporations created iu other States to acquire, by lesse or otherwise, the franchises or right to run, manage or control railroads in this State, without tie consent of the General Assembly. That the railroad, Doing a puDuc uiguway lor some pur pose s. was one of the publio institu tions of the State, and the State could uot permit it to pass from nnder the control and management of its own officials and into the hands of a foreism corporation without the consent of the State authorities expressly given. No change of the guage ol the Worth Carolina Railroad eould legally be made in the arbitrary manner sought by the defendants. The following is a synopsis of the line of argument of the defendants: They insisted 1. That under the following sections of the charter of the North Carolina Railroad Company, the power to make the lease is plain. . "Sec. 6. By the name and stvle of The North Carolina Rail road Company,' and by that name shall be capable in law and in equity oi pur chasing, holding, selling, leasing and conveying estates, real, personal and mixed. - so far as shall be ne osssarv for ? the purposes embraced within the scope, object snd interest of their charter and no runner, "Sec. 25. That the said company may purchase, have and hold in fee and lor term of years, any land, tenements, or hereditaments which may be necessary for the said road,' ice, v .--.- : . , ' "See. 18. That the aid company shall have the exclusive right of con veyance or transportation of persons, goods, mercluuidise and produce over the said railroad,' Ac. (- "Sec. 19.' That the said company may. That aa the charter of the North Carolina Railroad (Vmpany makes no restriction upon their ower to eUh hah or change its guage, that powrr is protected by the decision in the lrt mouth Colli-? cane, and further that the State had passed no law to forbid the change. Such r if lit to ehauge the guage was transferred to the lUchmond t Dan ville Railroad Company, or, aa the North Carolina Railroad Compauy could do euch work by agent, that a far aa thia part of the loane ia con cerned they have authorised it to t an done by the Richmond and Danville Railroad Company. That the State of North Carolina had no power to niainUiu thia action; it should have been in the name of the Attorney-General. 1 he use of her name is not author ised by anv law. aud. therefore, the action should be dismissed. No specific grievance is set forth in the complaint Railroad cliartcr Ik mg private laws. the charters of other corporations not hiving been passed cannot be read for the purpose of showing the injury that would be done thera by thia change. The auit can only m ma'ntoined on the idea of aa indiotable nuisance. There are no points here stated to support an indictment The State gave its ponscut through its regular officers Uie powers of these officers were derived through publio laws, and they did not exceed their power. Practicallv. therefore. the State's assent was given through publio law aud to allow this suit to be maintained would be assorting that a lease which the State authorised coulo not be accepted, without sub jecting the party to indictment by the Btate, which would be an absurdity. The matter of the lease was called to the notice of the General Assembly of 1873 72, Thev declined to take ac tion. The matter of the change of guage was called to the attention of the (tunerai Assembly by the Governor in his last annual monuign, and they paid no regard thereto. This is an acquies cence on her part and as she gave the Attorney General no directions by passing a law to direct hira to sue, lie has exceeded his power.
