They shall have power to appoint the neoessary oflloeis to operate and manage said road and keep tbe same, in repair. The Committee say that the liquors attached by the Marshal were left almost as fully snd freely at the disposal of the defendant in tlie suit as if no attachment bad been made; that he did so dispose of them, and thst without incurring any liability to the Marshal or subieotiug the Marshal to sny liability to thenlairitiiThafnim this a ready means of evading the laws of the State. Tbe State conBtab'e acted only in the strict discharge of a all the net earnings and iuoome of said road, and the Treasurer shall krfcp an accurate sooonut of all sums of money so paid in, andnote the same in nis reports to De suomittea to tne General Assembly. Tbe said Com nvrsioners before entering upon tl eir duties herein provided for, shall exe cute a bond pay able to the State of North Garohua (wLich shall be ap proved by the Governor) in sueh sum as may be ncoesrary to secure the State, bnt in no case shall said bond be less t ian double the amount of the net earnings for the proceeding year: Provided, That no person shall be ap pointed commissioner who has been oonnected with any fraudulent traus aotion in connection with any railroads or other publio works of this State. Sec. 4. That the publio Treasurer shall, on demaud, after maturity, pay out of the moneys received from said railroad, the interest upon the bonds authorised by this act, and if at any time tliereshal not be suffioientfunds on hand to fully discharge such interest, then he shall pay such deficit out of the general fund,' keeping au accurate account of the advauoes so made, which shall be a lien upon the rail road and all its property, second only to the mortgage heretofore provided for.
