Mr. Merrimbn moved e suspension of the rulet to put the bill on tie passage. He waa satisfied the courae pa need by the Treasurer waa wrong. There was really no injunction in the case. Mr. Seymour said it was the opinion of some of the counsel for the Btate that the order issued by Judge Bond operated as an injunction. The niotioa to suspend the rales prevail ed and the bill was read the second time. Mr. ilerrtmoa stated the condition of the suit, lie had examined the papers which .consisted oi en order of the Judge calling upon the Treasurer to show cause why an injunction should not be granted, and that no bond waa on file. ,. lie, (Mr. M.) could Dot see bow any lawyer could look upon a mere tubposaa as eo to.tonctiou. The counsel referred ta by Mr. Seymour do not pretend there is an order of Injunction, but merely state that in the event of one being hereafter issued it would be made to take effect from the date of the subpoena. The At torney . Ooaerai lor the (tute was of opinion there wsa no injunction granted, had told the Treasurer so in Ills (Mr. M.'s) presence, and bad told bim (Mr. M.) so ia a conversation. Two of tba Attorney's associate counsel had eipreeaed the opinion that If sn injunction were granted on the SOth Ini'. , it would date back to tbti' aeiviug of the original notice, and nothing more.
