At a tubtequent hour the Attorney General re tponded aod stated, giving his reasons for tit opinion, mat no such injunction existed. ' Messrs. At 13 18 p.m., the special order, Mr. Moriimos't bill to be entitled " An Art in relation to the duties ot tbe Public Treasurer " wss considered, the question being on the second reading of the bill. Mr. Norwood offered a resolution as a substitute, to the effect that no injunction existed, tbst the Treasurer Is required to pay tbe lawful demands made upon the treasury, and that in doing so be would be sustained by the General Assembly. Mr. Mcrrimon proceeded to address the Senate on tbe main question. Tbe pre amble of his bill, be said, set forth two facts first, that the treasurer bad refused anil atill refuses to dsv lawful demaadt upon tbe treasury, and, secoedly, thst no to 14, as follows: injunction exiaiea rtsirtiuiiig uim irom doing so ; and Mr. Merrimon proceeded to show these allegations to be true. He thru discussed the provls'ons of bis bill, which were, simply to compel him to per form hie duty aader tbe proscribed pe nalties. Mr. Love was opposed to the reference, as nothing was to be gained by the delay. There was no use in deferring the matter. Mr. Murphy did not like any one of the propositions submitted be spoke at a non-prtfensional. If there was any prin ciple involved, the matter of time should be ignored aod the question at once set tled. He desired to know U this was an appellate case.
