No. 5.1 AST ORDINANCE TO PROVIDE FOR COLliECT INQ THE TAX ON SPIRITUOUS LIQUORS MANUFACTURED OR SOLD IN THIS STATE, IMPOSED BY AN ORDINANCE OP THIS CONVENTION, WHICH WAS RATIFED ON THE 21st DAY OF FEBRUARY, 1862. 1. Be it ordained ly the delegate of th people North Carolina, i Convention aiembledr and it i hereby ordained by the authority of the same, That the Sheriffs of the several counties in this State be,; and they are hereby, authorized and directed to col lect from the distillers of spirituous liquors iu their respective counties, the tax of thirty cents - per gal lon " on each gallon of spirituous liquors manufac tured in this State," and of "one dollar on every, gallon of spirituous liquors sold in this State not the manufacture of this State," imposed by an ordi nance of this Convention, , ratifiod February 21st, 1802, at the time they, the said Sheriffsy collect the other taxes as required bydaw. The said Sheriffs shall have power and authority to administer oaths to Bnch distillers or sellers as to the quantity distilled or sold by them, in all cases where the game shall .not have been regularly listed at the time for listing tarfables, and shall collect !the tax on the same, in all cases, whether the said distillers or sellers may have listed the same at the tinie they listed their other taxables or not. The Sheriffs of the several counties shall, o paying nto tne Treasury the taxes of their respective counties, render a separate account or 'schedule of the tax collected from this so.urce, to be set forth by the Comptroller in his annual-official report. 2. Be it further ordained, That any person who shall refuse or neglect to state, on oath, to the Sheriff as before provided, the quantity of spirituous liquors manufactured or old, as the case may be, and to pay the tax on the same, as imposed by law, shall be guilty of a misdemeanor, and in addition to the lia bility to pay double taxes, such person shall be in ducted in the County or superior Courts, and on con viction, shall be lined at the discretion ot the court; and it js hereby made the duty of the grand juries to present all such delinquents, and it is aUo made the duty of the Sheriffs of the several counties of this State to report to the County or btate Solicitor tor their counties, the names of all persons that may fail or retuse to rentier a statement, unaer own, to me SheriS, of the quantity of spirituous liquors manu factured or sold by them; and this ordinance shall be siven in charge to the grand juries of the courts of the several counties in this State; and any Sheriff of any county in, this State, who shall fail or-refuse to discharge the duty imposed on him by this ordi nance, shall be indictable as for a misdemeanor, and, on conviction, fined at the discretion of the court. Whereas, By the construction which, in practice, has been given to the Constitution of the State, the Speaker of the Senate, in case of a vacancy in the office of Governor, shall exercise the powers of Gov ernor by virtue of his office as Speaker, and without vacating the same, which said office of Speaker mast cease and determine with that of tne incumbent as a Senator, upon the election of his successor in the next succeeding Senate, and the same construction would apply to the succession of the Speaker of the House of Commons to the exercise of the powers of Governor; and, whereat, according to this construc tion, a vacancy will take place in the office of Governor from and after the day of the next election on the first Thursday in August next, until the first day of Jan uary, A. D., 18(53, against whichht is the duty of this No. 1. Be it further ordained, That the Secretary of State, the Treasurer and Comptroller, shall, on the fourth Thursday in August next, in the presence of the Governor, proceed to examine said returns, and ascertain and declare what person shall have received the greatest number of votes, whereupon the Governor-shall issue his proclamation, declaring such per son duly elected Governor of this State from the second Monday of September, A. D., 1862, until his i successor shall be qualified. 4. lie it further orduinedf That the person so de clared and proclaimed Governor as aforesaid, shall, on the second Monday of September, A. D., 1862, 'appear before some Judge of tho Supreme Court, or some one of the Judges of the Superior Courts of Law, and take and subscribe the oath now prescribed by , law for qualification of Governor of this State, and shall immediately enter upon the discharge of the duties of his office, which oath, so taken and sub scribed, shall belled in the office of Secretary of State. 0. Carolina! in Contention aeiembled, and it it hereby ' ordained by '"the authority of the tame, That' under the 7th section of "An Ordinance to raise North Carolina's quota of Confederate Troops," the bounty te privates, musicians and non-commissioned officers shall be paid as follows: To all volunteers between eighteen and thirty -five years of age, for three years or the war, including those accepted di rectly by the Confederate Government, where North Carolina b or may be credited for the same ; to all volunteers between eighteen and thirty-five years of age for a less term, re-enlisting or eontinuing in ser vice for three years of the war, including their for mer term, by virtue of the Conscription Act of Con gress; and to ail persons, substitutes excepted, mus tered into companies already organized, or organized into companies preparatory to active service by vir tue of said Act of Congress t Provided, however, That the officers of all volunteers directly to the Confederate Government, elaiming the said bounty,,, shall make such returns as the Governor may require. 2. Be it further ordained, That tho bounty to those now in service shall be due presently and be paid according to seniority of regiment. 3. Be it further ordained, That the Governor be, and he is hereby directed to discharge all volunteers over thirty-five years of age not yet transferred to the Confederate Government, that, may desire a dis charge. . 4. Be it further ordained, That all volunteers for for three years or the war tliat have volunteered or may volunteer before the seventeenth of this monthf and shall continue in service for the war, shall be entitled to the bounty of fifty dollars as, heretofore paid, although they may be over thirty-five years of age. AN ORDINANCE EXEMPTING THE PROPER TY OF DELINQUENT SOLDIERS FROM DOUBLE TAXES. Whereas, At the time prescribed by law fox list ing taxable property in thiaj State, many of its citi zens were in the military service of their State and of the Confederate States, and in consequence thereof failed to give in their lists of taxable property ; therefore, Be it ordained by the Delegates of the People of North Carolina in Convention assembled, and it is here by ordained by the authority of the same, That the Sher iffs of the respective counties in this State are here by instructed to collect no more taxes from such de linquents than they would have been liable for had they rendered in their lists of taxables according to law. Hoskins the sum of one hundred dollars for his services as Chaplain to the Seventh Regiment of North Carolina Volun teers, from the twenty-ninth of August, 1861 to the twenty-ninth of October, 1861, while prisoners of war, and that he be allowed the same in the settle ment of his public account. AN ORDINANCE PROVIDING FOR JtN IN CREASE OF THE SALARIES OF THE TREAS URER, COMPTROLLER AND SECRETARY OF STATE FOR THE YEAR 186J. Sxctiok 1. Be it ordained by the delegates of the people of North Carolina in Convention assembled, and it is hereby ordained by the authority of the same, That for the year eighteen hundred and sixty two, the Treasurer of this State shall receive as his salary, twenty-five hundred dollars the Comptroller 8 hall receive fifteen hundred dollars, and the Secre tary of State shall receive one thousand dollars. AN ORDINANCE TO ENLARGE THE POLICE POWERS OF THE SEVERAL CORPORATE TOWNS IN THIS STATE. Sectioh 1. Be it ordained by the delegates of the people of North Carolina in Convention assembled, and it is hereby ordained by the futhonty of the same. That tbe corporate authorities of the several cities and towns of this State, shall have power to regulate, restrain or prohibit within their corporate limits, or within one mile thereof, the sale of spirituous li quors : Provided, nevertheless, ; That where any tax shall have been paid for an annual license, it shall be the duty of the Commissioners to make a pro rata compensation for such time as such license shall be suspended. Sec. 2. Be it further ordained. Be it ordained by the delegates of the people of North Carolina in Convention assembled, and it it liereby ordained by the authority of the tame, That John C. Washington, James E. Hoyt, George Washington, and William Murdock, their associates, successors and assigns, be, and they are hereby cre ated and constituted a body politic and corporate, by the name and style of " The Sapona Iron Company' and as such, shall have perpetual succession, and may have and use a common seal, and change the same at pleasure ; may sue and be sued, plead and be impleaded in any Court of Law and Equity ; shall have power to make all sutfh by-laws and regulations (not inconsistent with the existing laws and Consti tution of this State,) as may be deemed necessary for the government of said Company, which shall be bind ing thereon, and shall have, exercise and enjoy all the rights and privileges of a body corporate neces sary or requisite to carry on the business of explor ing and mining coals, iron ores, and other minerals, and smelting, manufacturing, transporting and vend ing the same; and shall also bave power to purchase, lease, hold, convey, and dispose of any estate, real and personal : Provided, That said corporation shall,, at no one time, hold more than twenty thousand acres of land. Said company shall have, also, the right, power and authority, to build and construct roads and ways, whether tram, plank dr turnpike. and to charge the same as to them may seem advis able, for the transportation to, from, er between their mines and furnaces 'of iron, coal, coke. ores. minerals, and materials, and also to construct such canal or canals and drains as may be required or needful for the supply of water to their, furnaces, the transportations of coal, ores, and materials as afore said, and the drainage of their mines ; and that any or all of such roads, canals and drains shall be opened to the use ot the public upon the payment of such reasonable tolls and compensation, and subject to such rules and regulations as said corporation may, by their by-laws, estabiisn. Sec. 2. JJe it further oraained, That when any lands or rights of way may be required by said Company for constructing said road, canals, or drains, and for the want of agreement as to the value there of or for any other cause, tbe same cannot be pur chased of - the owner or owners, the same may be ta ken and the value thereof ascertained, as follows, viz ; On application by the Company to any Justice of the Peaco, for the county where said land or right of way may be situate, it shall be his duty to issue his war rant to the Sheriff of said county to summon a jury of at leet five freeholders, to meet on the land, on a day expressed in such warrant, not less than five nor more than twenty days thereafter, and the Sheriff on the receipt of said warrant, shall summon the jury, and when met, shall administer an oath or affirmation to them, if three or more appear, that they will im partially value the land in question, or right ef way. A he proceedings 01 sucn jurors accompanied by a description of the land or right of way, shall be returned under their hands and seals, or a major ity of them, by the Sheriff to the!
