Broadcaster Sues
Florida Officials
QUINCY, Fla. (IP) — A $10,000
damage suit was filed ifi federal
court in Thomasville, Ga., today
against the mayor and chief of
police of Bainbridge.
The suit, involving freedom of
the press, was filed by Ben Let
son, owner of Quincy radio sta
tion WNCH. It charges false im
prisonment as a resuLt of the ar
rest of Leison for broadcasting a
football game between Bainbridge
and Quincy on Nov. 1.
Tallahassee attorney J. Ken
neth Ballinger, representing Let
son, said to his knowledge it is
the first time the question of radio
j broadcasting being included in the
I term “press” as outlined in the
Constitution has been raised in
federal court.
The case will be heard in Ma
con, Ga. Mayor R. A. Cheney
Griffin, brother of Georgia Gov.
Marvin Griffin, and Chief of Po
lice M. A. Martin have 20 days
in which to file an answer.
The suit maintains that a radio
station has the right to broadcast
a news event under the protec
tion of the Constitution whioh
guarantees freedom of the press,
it contends a radio station is en
titled to the same constitutional
protection as other news media
in reporting the news.
Letson was arrested by Bain
bridge authorities in the middle
of a broadcast of a football game
and charged with operating a bus
iness without a city license. He
posted a $200 bond at city jail
and was released, but later was
fined $200 in city court.
The arrest followed a hide-and
seek game between Bainbridge
authorities and Letson. The broad
cast team, composed of Letson, sta
tion manager Bill Taylor and sport
seaster Dewitt Owens, broadcast ;
three and one-half quarters of the i
game before they were stopped.
Police were tipped of the broad
cast was going over the airways
and began a search for the broad
casters. They were found broad
casting from the home of Dr.
Henry A. Bridges adjacent to
the high school football field.
