Upchurch, for several years a member of the firm of Upchurch & Holder, died Tuesday night after an illness of less than a day, having suf fered a stroke of apoplexy in the morning. Mr. Upchurch was at his business with the Pace Mule Company when he was stricken. He was immediate ly taken home. He never regained consciousness. Norfolk. Smith, President of the State's Trust Company of Wilming ton, which was the head of several mushroom banks in this State, was arrested in Alabama a few days ago. Smith refused to come to Raleigh. Governor Craig sent requisiton pa pprs to the Governor of Alabama and that Governor has honored Governor Craig's request. Smith will be re quired to give heavy bond when he arrives in Kaleigh. Governor Craig I'ai dons Three. Governor Craig has granted a par don to Grant Brignian, convicted in Buncombe County in November, 1H09, of manslaughter and sentenced to four and a half years on the roads. A pardon has been granted Henry Reynolds, convicted in Gaston Coun ty in September, 1909, of criminal assault and sentenced to eight years on the roads. John best, a Greene County man convicted in February, 1905, of bes tiality and sentenced to ten years, is pardoned after serving eight years. Special Kailioad Committee to Meet Here To-morrow. The special legislative commission which was appointed to adjust freight '..,toB win mpt here to-morrow with representatives of the various rail roads in an effort to correct the abuses in freight rates from western and northern points to North Caro lina cities. President Finley and General Counsel Thorn of the South ern will have a plan to suggest, and the special commission will present its grievances. The commission is composed of Senator V. B. Council, Representative K. J. Justice, and Mr N. B. Broughton. present. j The newspaper men, at these ban- ; quets, manage, in the way of speeches and dialogues to get off a number of clever hits on public men and current events. At this last din ner one of the features was to have ! two fruit carts brought into the ban- i quet room, one labeled "The Demo cratic Fruit Cart" and the other ! "The Republican Fruit Cart." The fruit in the Republican cart was la beled "high protection." "trusts." etc.. and pushed by a man labeled the interests." The fruit in the Democratic push cart was labeled tariff for revenue only," "income tax," "trust busting," etc., and was pushed by a typical Democratic poli tician who denounced the Republi can mm as bad and unwholesome and called upon all of the patriots to come up and buy the Democratic fruit. Soon all of the fruit from the Democratic cart was bought, while not a piece from the Republican cart was purchased. After the Democratic push cart man had sold all of his fruit it was no ticed that the plutocrat who stood by the Republican fruit cart was smil ing broadly. He was asked why he smiled. His answer was: "O hell, I own both carts." The force of this hit will be fully appreciated by the people of North Carolina who know how Mr. Sim mons and his Democratic machine has mortgaged the State to the trusts. Ga., has reported to the po lice that he was knocked in the head and robbed of $212 Saturday night in a negro house out on the Hollo- man road near Raleigh and charges a negro woman, Sallie Dulley, with the crime. He admits that he was drinking at the time. He was car ried to the house by a hackman. The woman was arrested by the police and others believed to be accom nlices are being looked for by the police. Sumner was very painfully injured. The negro woman was tried in police court Monday and sentenced to North.
