Most States until recent years recognized common-law marri ages. At the present time they are permitted in eighteen States. They are: Alabama, Colorado, Florida, Georgia, Id aho, Indiana, Iowa. Kansas, Michigan, Mississippi, Montan a, Ohio, Oklahoma, Pennsyl ! vania, Rhode Island, South Carolina, South Dakota, and ! Texas. Common-law marriages, in those jurisdiction where such 1 are authorized, are Just as binding as a ceremonial marri age. They can be terminated : only by annulment or divorce. , What is a common-law mar riage? , To constitute a common-law marriage there must be a pres- , ent agreement between a man , and woman, eligible to enter into such relationship, to take each other as husband and WISDOM OF THE J AGES I IVlie. All that is necessary is that the parties shall intend to marry, and their intention je proved either by their words >r by their conduct. No solem lization or other formality, a part from the agreement itself, is necessary. No witnesses arc required. The agreement being the es sential element in these marri ages, it may, like any other agreement, be proved by words jr by conduct, and by the testi mony of the parties themselves >r by the testimony of third persons. What are the requirements >f a valid marriage in North ITarolina? Briefly stated, any man and vornan entitled by law to be narried may do so by appcar ng together before a minister >r justice of the peace and vol Jtitarily expressing their seri >us intent to be husband and wife, and having the minister >r justice of the peace declare hem man and wife. No witneeese are required. What are the marriages pro libited by the law of North Carolina? Interracial and bigamous narriages arc absolutely void. V marriage between a white »erson and a Negro is an ex mple of an interracial marri ge that is void. If a man ent rs into a second marriage be ore his first marriage has been lissolved by divorce or death if his first wife, the second narriage is bigamous and void. It is the marriage ceremony, and not the obtaining of the license prior to the marriage cere mony, that determines the val idity of the marriage. In most States marriage lic ense statutes are construed as directory only and not manda tory. Under this view, a valid marriage may be created with out first obtaining a marriage license. A statute which is deemed directory merely points out, a way by which a result can be certainly accomplished but which docs not say that it is the only or exclusive method by which the result can be ac complished. The fact that the license may have been obtained by fraud or perjury, or that the consent of parents is not obtained as specified by statute in certain cases, does not prevent a mar riage ceremony from being ef fective.
