RAMSAY'S 'CASE NOL PPOSSED Admits He Was Wrong and Will Be " tract In The Progressive Parmer ' Next Week. The genial doctor soon Informed his ' brethren of the order that the case of criminal libel against him had been ,' nol pressed In Wayne Superior Court by Solicitor Fou. Mr. Ramsay became satisfied that he - had misrepresented Judge Allen and he agreed to make full and complete re- traction of the charge preferred against him In next week's Issue of the Pro gressive Farmer. Upon these condi tions a satisfactory arrangement was made and the case was nol prossed. -- Mr. J. W. Denmark, the business man . ager of the paper, and Col. T. M. Argo, counsel for the defense, returned with Dr. Ramsay. - TWO LARGE CORPORATIONS. Big $50 000 manufacturing Com pany and Gas Plant for Washing ton. The Washington Gas Company was yesterday Incorporated by the Secie Ijiv nf State. The amount of capital stock Is to be 140,000 and the amount may be increas ed to $200,000. The corporation Is to be located at Washington, N. C. Th, incorporators are A. M. Durmay, B. I. Nicholson, a. W. Benedict and Jos eph .P. Jackson. The Norwood Manufacturing Com pany, of Norwood, Btanly county, va also Incorporated with a capital stook of (50,000. Privilege is also granted 1Q Increase to 200,000. The company Is empowered to carry on the manufacture and sale of cotton, cotton goods, wool and woolen goods and to erect mills and dwellings, etc. The incorporators are J. A. Tyson, D. B. Coltrane, R. H. Stowe, D. N. Ben nett, M. E. Blalock, h. H. Lenty. L. A. Lenty. E. M. Anbury, D. B. Bennett and F. H. Lilly. MR. M'CHEfc TO VACATE And Mr. W. R Tucker Will Proceed at Once to Erect His Five-Story Building. Mr. W. R. Tucker, the purchaser of the Battle property, on the corner of Fayettevllle and Martin Btreets, has come to a satisfactory arrangement with Mr. J. W. McGliee, the occupant of the stor"1, who had a three-year lease on the property, whereby Mr. McGljee vacates In crder that Mr. .Tucker uiuy erect his new building. Mr. Tucker wants possession of the property by Monday next in order that he may begin work at once on the iu-a building. Mr. McOhee will move lo li i office now occupied by J. M. Brou:;..i.;. & Co. until the new structure in com pleted. Then he will take the corner store, with an office in the rear. As previously announced In thin paper, Air. Tucker proposes to erect a five-story building. The stories above the first will be devoted to offices, and the lower floor will contain store rooms. The burglars who entered the resi dence of Mr. Maxwell Gorman last Thursday night, and after stealing a supply of goods, attempted to kill Mrs. Gorman with a knife, have been arest ed. George Adams is the name of the negro who perpetrated the crime. His arrest was accomplished by the clever detective work of officer Mart Thomp son. Adams was arraigned before Mayor Rubs yesterday afternoon and given a preliminary hearing. The stolen goods were traced to the house of two colored women, where Adams had carried them. His guilt was made complete by being Identified by Mrs. Gorman as the man who attempted to stab her on tne night of the burglary. -Mayor Russ bound Adams over to the next term of the criminal court without bail. He will be tried for his life on the charge of burglary. Coy Horton was held under a 100 bond as a witness In the case. Falling to give this he was committed to jail. The police have been diligently work on the case and yesterday their labors were rewarded. Among the gro ceries, matches, &c.,. stolen was a flat iron. Officer Mart Thompson took this Iron as his clue and went to work. He was ably assisted by officers Mullt.i and Conrad. Mr. Thompson found one of the irons stolen in the house of a negro woman. He questioned her and was told that George Adams, a negro, gave It to her. George Adams, the prisoner, Identi fied as the man who attempted to strike Mrs. Gorman with the knife, Is a bad character, and has served two sen- ences In the State prison. WHO IS LIABLE FOR THIS SUM ? Chadbourn and the State Evading responsibility of Castle Hayne Purchase Mr. R. T. Gray, the referee In the Cns- tle Hayne farm case, appointed at the last term of court, began the examina tion of witnesses yesterday. It will be remembered that Mr. Chad- bourn bid In the Castle Hayne prop erty when first offered at public auc tion for JI6.100. The Kid was made lor the State i-snMentlury. so Mr. Chad- bourn stated. Later the Governor de eded that the prison had no right to Tiake the purchase. The property was again sold and Mr. Chadbourn bid it n for himself at js.whi. Now the parties holding mortgages on the property claim that either the penitentiary or Mr. Chadbourn nim- :ajf is liable for Jltt.uou, tne amount or the original bid. If Mr. Chadbourn made the nrst b'd with authority for the prison, then t Is claimed that the State is liable. It not, then Mr. Chadbourn must be lia ble. Mr. Chadbourn was examined yes terday. He slated that he acted for Governor Russell and the then Super intendent John R. Smith, and was au thorized by them to make the purchase: that John R. Smith was present at tne sale; and that the Board subsequently ratified his action In making tne pur chase. The hearing was continued until May 10th, when other witnesses will tie examined. The case Involves the right of the Governor to appoint a director to a public institution where the Legislature fulled to elect when the statute so pro vided. Yesterday morning counsel for the plaintiff appeared in the Supreme Court and asked that the case be udvanced on th docket and heard at the present term. The motion was taken under con sideration. M. H. Holt was appointed a director of the hospital at Morganton by the Legislature of 1891 for a term of six '-ears. The Legislature of '97 failed to elect as required by law. The Govern or then took the view that a vacancy existed and appointed Bristol, along with others. Suit was Instituted to test the right of -the Governor. Now the Supreme Court will decide whether a vacancy existed and whether Holt holds ou. J. C. L. Harris and Capt. W. H. Day are counsel for Bristol, and R. O. Bur ton appears for Holt. NEW LESSEES OF THE ACADEMY. Messrs R C. Rivers and Guy V Barnes Get the Hall for 5 Years. As announced yesterday In the Post the Academy of Music will be reopened next season and will be remodelled. It was given out that Mr. S. A. Schlnss, the manager of the Wilming ton opera house, had leased the Acad emy. Mr. Schloss thought that his bid bad been accepted and so it would have been had not Mr. Page received a better offer at the Inst moment when he was about to close the deal with Mr. Schloss. Mr. R. C. Rivers, the business man ager of the Caucasian, and Mr. Guy V. Barnes, the State Printer, have enter ed Into a five year contract with Mr. Page for a lease of the Academy. The terms of the lease are not known, though It is said the rental Is In the neighborhood of $500 per year. The new lessees announce that they will bjok only first-class attractions and that they wilt give Raleigh the best that come this way. Mr. R. C. Rivers, who will have the active man agement of the Academy, has had much valuable experience with some of the best theatrical attractions and he is thoroughly conversant with the busi ness. Mr. Rivers Is going to give Ral eigh a class of attraction's worthy of their patronage. The new lessees are In negotiations with Prof. Meares for a lease of the Metropolitan. -In the event that con trol of the Metropolitan is secured It will be closed and all attractions .pre sented at the Academy.
