NOTICE OF SALE Notice is hereby given that in pur suance of and by virtue of a decree in the above entitled cause by his Hcr.or, I. M. Meekins, Judge, dated November 2, 1926, we, as Special Commissioners appointed for sue! purpose by the saiti decree will sell at public sale to the highest bidder upon ihe terms hereinafter stated, free ol ali right and equity of redemption of the Branning Manufacturing Com pany, at the Court House door at Columbia, in the County of Tyrrell State of North Carolina, on Monday the 28th day of February, 1927, be tween the hours of noon and twp o’ clock P. M., the following tracts of land as described in the above en titled cause and also as described in a deed of trust executed by the Bran ning Manufacturing Company to Caluwell Hardy and others, dated the 1st day of July, 1915, and duly re corded in the County of Tyrrell in the Register’s office thereof, in Book 67 page 122, all of said lands being situ ated in the County of Tyrrell, Stato of North Carolina, and more par ticularly described as follows, to-wit: I All mose several tracts of land which were conveyed by the State Board of Education to Hor.on Cor win, Jr., by three several deeds (a) Deed data! September 24, 1901 and recorded in the Register’s office of Tyrell County in book 47 page 594, conveying a tract of land c ntaining ;wo thousand seven hundred and twenty (2720) acres; (b) Deed dated September 24, 1901, and recorded in the Register’s office of Tyrrell County in book 47 page 596, and conveying a tract of land contain ing one thousand nine hundred and thir y-seven and one-third (1937 1-3) acres; (c) Deed dated February 1, 1202, and recorded in the Register’s office of Tyrrell County in book 49 page 124, and conveying a tract of land con taining two thousand (£000) acres. Reference is hereby had to the fol lowing deeds executed to the Bran ning Manufacturing Company, which were intended to perfect the title and th<- boundaries of the above three de scribed tracts of land, which deeds are herein recited as to the grantors, the date thereof and the book and page where recorded in the Register’s office of Tvrrell County, as follows (a) Deed from D. S. Mann and wife dated May 27, 1897, and record ed in book 45 page 18; (b) Deed from H. C. and J. M Alexander, dated May 27, 1897, and recorded jn book 43 page 335; (c) Deed from John Williams and wife dated May 24, 1897, and record ed in book 43 page 14; (d) Deed from W. M. Gray and wife, dated January 16, 1200, and j recorded in book 47 page 34; ! (e) Deed from A. L. Walker and wife, dated February 1, 1901, and recorded in book'47 page 413; (f) Deed from W. R. Spruill and others, dated February 12, 1902, and recorded in book 29 page 122; (g) Deed from W. T. Reyborn and, v.-ife, dated April 16, 1204, and record ed in book 52 page 1. The lands conveyed in the three several deeds from the S ate Board of Education to Horton Corwin, Jr., and hereinafter referred to, are con tained in paragraphs 19, 20 and 21 in the original deed of trust to Cald-: well Hardy and others, and were con veyed by Horton Corwin, Jr., to tne Branning Manufacturing Company by deed dated June 20, 1903, and re corded in book 50 page 439. II A tract of land containing seven thousand nine hundred and thirteen (7913) acres V- survey, which tract or' kind is composed of contiguous tracts which were acquired by the Branning Manufacturing Company at various times under deeds as herein rocked, in which the grantors, the date thereof and the book and page where recorded in Tyrrell County, is set forth: A. Deed from I. M. Meekins and wife, dated December 15, 1913, and recorded in book 63 page 592; B. Deed from Thomas and J. A Spruill, dated September 6, 1900, and recorded in book 41 page 109. This and the foregoing deed are No. 18 and No. 22 in ihe aforesaid deed of trust to Caldwell Hardy and others and which are known as the Colling Allen and Dickinson tract of land Reference is also had to the follow ing deeds executed to the Branning Manufacturing Company as to which the names of the grantors, the date thereof and the book and page where recorded in Tyrell County are herein recited, and which deeds were intend ed to perfect the title and boundaries to the second tract of land described in this paragraph and designated as “B”, to-wit: uet'u juim oeiiciii in. nau^nwii and others dated March 27, 1900, and recorded in book 47 page 153; (b) Deed from W. Lynch and wife dated Sep ember 10, 1902, and record ed in book 52 page 434. C. Deed from S. M. Combs ano wife dated March 10, 1917, and re corded in book G3 page 425. D. Deed from D. O. Newberry dated March 0, 1917, and recorded in book 68 page 430. E. Deed from W. 13. Coppersmith, dated October 7, 1916, and recorded in book 68 page 266. F. Deed from J. W. Howett and wife dated November 18, 1915, and recorded in book 68 page 253. Wherever deeds are referred to by name of grantor and book and page where recorded reference is made to said records for full descrip tions. The terms and conditions of this salt are as follows, to-wit: The purchaser shall pay onc-fourtr or the purchase money in cash upon the execution and delivery of deed and the balance in three equal annual installments, payable in one two and three years bearing six percent in terest, and secured by a deed of trusi to be approved by the Court with the right of any purchaser to anticipate at any time any or all of such In stallments or to pay all of the pur chase money in car'll at the time of the purchase. Any bidder shall be required to deposit, or by certified bank check, t:n percent of his bid ar, evidence of good faith and in default thereof any bid may bo rejected. Any creditor of the Bravmrdg Manufactur ing Company or any stockholder thereof, may become the purchaser or purchasers at such sale, and any lienholder who shall purchase at such sale shall have the right to use the amount due him on his lien, either as a deposit on his bid or in payment thereof, in the manner diree’ed by do. cren of Court. The Commissioners in their judgment may first offer the lands in separate tracts or parcels and then offer all the lands as a whole and accept the best and highest bid. This 21st day of January 1927.
