It is further set forth in the instru
ment of appeal that the president of
the Brevard Banking company, in ac
cordance with instructions of board
of directors of said bank, approached
one Henry N. Carrier, known to be
the husband and acting as agent for
the said Mrs. N. B. C. Carrier, and
through false and misleading repre
sentations, induced said Henry N.
Carrier to purchase for her 100
shares of stock in said bank, paying
therefor the sum of $15,000.
The instrument declares that said
Mrs. Carrier was not aware of the
actual"* conditions of the bank until
it had closed, nor had she been in
formed previously of the fraud which
had been practiced upon her; that as
soon as the liquidating agent, when
appointed, was informed " through
agent of her repudiation of the pur
chase of the stock because of the
fraudulent manner in which it had
been sold to her through her agent, I

Mrs. Carrier asks, first: That herj
subscription stock in Brevard Bank- !
ing company be cancelled;
Second: That she have and recover
from the said Brevard Banking com
pany the sum of Fifteen Thousand
Dollars, and interest thereon from
the date when this sum was paid to
said bank, and that said judgment be
declared a preferred claim against
said bank by favor of this defend
ant, and
Third: That the stock assessment
and judgment filed against her in the
office of the clerk of the court for
Transyvania county be set aside and
declared null and void.

"My greatest desire is that the best
interests of Transylvania county and
its schools be improved and benefit
ted, and not stirred up by litigation.
"I do not admit, however, that any
mistake has been made, and I have
received no communication from the
state board of education, ftor the
board of equalization, as to what my
rights are. But I do not feel inclin
ed to accept any office about which
there is the slightest question.
"I, therefore, respectfully tender
my resignation as county superin
tendent to take effect immediately up
on the election and qualification of
my successor.

A. W. Allen, Scout executive of the
Daniel Boone Council, was' in Bre
vard Tuesday morning taking pic
tures of the local Scout troop and
j Brevard Scout executives. The pic
! tures will be used in a film showing
the work of the Scout from the Ten
derfoot stage to that of Eagle.
| A short reel of the local boys and
! their leaders was made on the
j court house lawn. The picture, which
will embrace all phases of the Scout
work will be. ready for showing with
in a couple of months, and will, Mr.
Allen announced, hav<!_ all troops in 1

the reel.
Mr. Allen was profuse in his praise
of the local Scout work, giving spe
cial praise to the efforts of Fred
Miller, leader of the movement here.

cases where defendahts are in jail,
awaiting the December term. All
these will be tried at the coming Aug
ust term, since this term has been
changed from a civil to a mixed dock

and relieve the county of supporting
many defendants from now until De
cember court.
Of, course, ,it is pointed out, in
cases that have been set for hearing
at the December term, and bonds for
appearance at that time have been
posted, will not be tried until the
December term.
It is believed that many days will
be requited to try all the cases con- '
nected with the bank's closing. Judge
Hoyle Sink is to preside, while J.
Will Pless, Jr., will represnt the
state. Pat Kimzey, attorney for the
liquidating agent " of the Brevard
Bank, will appear in all cases where
in the commissioner of banks is in
terested.
Dick Zaehary is chairman of the
jury commission, and Dan W. Merrill
and E. A. Reid are commission mem
bers.

WALTER W.ORR IN
PLANE ACCIDENT!
Hempstead, N. Y., July 14. ? (Spe
cial to The Brevard News) ? Walter
W. Orr, of Brevard, had a narrow
escape from death here on July 7.
when his parachute failed to open
immediately after he had jumped
from a plane at an altitude of 6000
feet. Mr. Orr had fallen fully four
thousand feet before the 'chute op
ened, and his body had gained such
momentum thftt when the parachute
did open it was badly torn, causing
the young man to land heavily.
Mr. Orr suffered a broken leg and
many bruises and cuts. He was
making a test jump and no explana
tion has thus far been made as to the
:ause of the failure of the parachute
to .open when he pulled the cords.
Mr. Orr is making rapid recovery,
and will soon be ablte, attending phy
sicians say, to leave the hospital, As
soon as he is able to journey, Mr. Orr
will sail for South America ip the in
terest of his employers. He is con
lected with Swift and company. ?
Mr. Orr is a son of Mr. and Mrs.
Dharley Orr of the Clough Farm. He
vas recently here oil a visit to his
jarents.
