Courts and Court Procedure 'The superior court organization remains unchanged, as the series of bills designed to increase the nu mber of regular judges, eliminate special Judges, re-number districts, and divide the state into 3 divisions never came out of commitee. A si milar fate met Senator Hobgood's proposal to admit alcohol blood te st Into evidence in drunken driving cases. -The bill setting up a tax co urt died with an unfavorable repo rt, as did a bill to prohibit public ation of names of rape victims, and a bill to require court records, ex cept in juvenile and adoption mat ters, to be open to public Inspect ion. The House approved comm ission to study the possibility of le gislation on uniform court costs for motor vehicle law violations, but the Senate Roads committee killed it. Oh the positive side, bills were ratified: (1) to make the 2 year st atute of limitations applicable to wrongful death actions, instead o the one-year condition precedent previously in effect; (2) to allow a defendant In civil actions to move for nonsuit at the close of all the evidence even though no motion was made at the close of plaintiffs evidence, and delete the require ment . for either party except to the granting or failure to grant the nonsuit motion in order to urge the court's ruling as ground for revers al on appeal; (3) in crimnal actions to eliminate the necessity for exce pting to refusal to nonsuit or dis miss in order to appeal and urge refusal as ground for reversal: (4) to bring the N. C. law into line with the federal law and make inadmis sible evidence obtained in the cou rse .of a search without a warrant; (5) to provide regulations to carry out constitutional amendment ado pted last year permitting waiver of indictment in non-capital cases; (6) to provide that no death sentence shall be carried out until certain certificates as to appeal have been received from the clerk of superi or court and prosecuting attorney; (7) to authorize a proceeding in su perior court when persons impris oned assert that their constitutio nal rights have been violated; (8) to permit clerks of superior court to take bail In all but capital cases; (9) to raise from $0 to $8 the max imum fees that county commission ers may allow jurors. The public contracts law was amended and the cost of supplies which may be pur chased without - written contract raised to $25,000 were approved (HB654). "Slum clearance projects for cities over 25,000 were approv ed (HB378). The retirement system 5f or local employes was strengthened by per mitting cities and counties to parti cipate in the federal social security program (HB274) and to adopt a 5 per cent contribution plan to in crease benefits (HB438). The effort to require full-time attendants in all- jails (SB96) was defeated, but municipal police were given . the authority to transport prisoners to and from jails outside the city (SB35). SB 97, permitting the temporary confinement of men tally ill persons In institutions oth er than Jails, was approved. Miscellaneous Matters of , Importance. Although scheduled to reappor tion Its representation under the state Constitution, the General As sembly made no changes, nor did it approve reorganizing state execu tive agencies into a maximum of 12 departments. Bills proposing a prison study commission and a bon us for veterans were killed by com mittee; bills designed to legalize the union shop and establish a mini mum wage and hour law met simi lar fate. A commission to study in surance requirements in conection with small loans was not approved, but the Commissioner of Insurance was empowered to regulate acci dent and health insurance policy rates without a prior study being made. Although a commission to regulate the marketing of milk met disapproval, legislation to provide emergency funds to combat lnfect uous animal diseases and to es tablish a voluntary program for grading meat according to U. S. standards has been enacted. The fertilizer law was amended to de fine manipulated and unmanipulat ed manures and to require registra tion of manure fertilizer brands for sale. Two new licensing boards were created, one to regulate physical therapists and one to reg ulate dispensing opticians. I'll beglad to send a few seed on request. Some gardeners believe that cucumbers and muskmelons will cross if planted near each other and that the melons will taste like cucumbers. This is a mistaken idea. Cucumbers and muskmelons will not cross in the field and, if the melon Is tasteless, it is due to too much rain at ripening time or to soil conditions, Different varieties of muskmelons will cross with each other but will not effect this year's crop - - only next year's crop if you save your own seed. If you plant yellow and white sweet corn varieties near each other the resulting cross will show un in the present season, and you will have a mixture of white and yellow kernels on the same ear. This is almost a pe rennial question after the bloom ing season. It is best to move them after the foliage has turned yellow and begun to die. While the foliage is green, the plant is storing food materials in the bulb for next year's bloom After the foliage has turned yellow, the bulbs may be dug, divided, and replanted at once or dried and stored in a cool dry place for fall planting. Even if you wish only one plant, they should be di vided, andlhe extra divisions given away, The "eyes" or sprouts-of the dahlia are formed on the crown or base of the stem not on the roots themselves, In dividing them, care must be taken to get at least one eye or sprout with each root or 'di vision. It is not necessary to have more than one sprout and one root. It has been my experience that it is best to wait until May to plant dahlias.
