In Superior Court , Jury Finds Woman Guilty Of Second Degree Murder A Superior Court jury found a local woman guilty of second degree murder Thursday. Annie Ruth Jacobs, 35, of Rt. 1, Box 624, Red Springs, had pleaded not guilty to a charge of first degree ""murder. Following four days of testimony, the jury found her guilty of fatality wounding Oscar Brewer, 49. Brewer was shot in the arm and the chest with a .32 caliber pistol. Judge D.B. Herring, Jr., aelayed . sentencing and ordered that a pre-sentence diagnostic study be done on Mrs. Jacobs and returned within 45 days. Through this study Herring indicated that the court wanted to know if the defendant was subject to delusions at the time of the offense, and if the defendant has any mental disorders. The diagnostic order also required that State Probation Officer, Larry C. Ingram, prepare a pre-sentence , Investigation report and forward it ' ' to the Diagnostic and Classification Branch in Raleigh. Following the jury's verdict, Mrs. , Jacob's bond was revoked and she was ordered to remain in custody of the Hoke County Sheriff's Depart ment. , In other action, Elbert Flowers, Rt. 1, Raeford, pleaded guilty to a charge of assault with a deadly t weapon inflicting serious bodily injury. He was sentenced to a term of not less than five nor more than eight years in jail. Flowers was placed on probation for five years on the conditions that he pay restitution up to SI, 000 to Moore Memorial Hospital and Pinehurst '' Surgical Clinic, and $600 for use of Ernest Jackson, Rt. 4, Raeford, plus court costs. Jackson had been stabbed in the right shoulder with a butcher knife. Further probation conditions re , quired Rowers to cooperate with his probation officer, remain within the state and not change his place / of residence without permission, ' violate no penal laws for five years, and that he totally abstain from use " of possession of alcoholic beverage. Charles Ray Bass, Lumberton, was sentenced to two years in jail after he pleaded guilty to driving while under the influence of intoxi cating liquor (fifth offense), carry ing a concealed weapon and trans porting an open bottle of alcoholic Magistrates Court ? The following speeding violations were heard by the magistrates: Marion McLaughlin, Rt. 1, Box 381 A, Raeford, speeding 65 in a 55 MPH zone, $5, plus court costs; Lou Vern Johnson, Rt. 3, Box 162, Raeford, 65 in a 55 MPH zone, $5, costs; Joel Max White, Whiteville, 65 in a 55 MPH zone, $5, costs; Gregory Ernest Tadlock, Char lotte, 65 in a 55 MPH zone, $5, costs; James Ell Morrison, Rt. 4, Box 291 K, Fayetteville, 66 in a 55 MPH zone, $10, costs; Everline Groves Johnson, Red Springs, 65 in a 55 MPH zone, $5, costs. Osborne Leroy Ellerbe, Norfolk, Va., speeding v0 in a 55 MPH zone, $10, costs; Gary Maxon Barnett, Trenton, Mo., 70 in a 55 MPH zone, $10, costs; Harold Regan Anderson, Jacksonville, Fla., 67 in a 55, $10, costs; Perry Rolland Akins, Charlotte, 66 in a 55 MPH zone, $10, costs; Larry Dunham, Ft. Bragg, 66 in a 55 MPH zone, $10, costs; Robert Harrison Tinsley, Waxhaw, 65 in a 55 MPH zone, $5, costs; Bryan Junior Parker, Fayetteville, 66 in a 55 MPH zone, $10. costs; Joseph Andres Haupt, 66 in a 55, $10, costs; John Stoval Allen, 70 in a 55 MPH zone, $10, costs. Other traffic violations heard included: Robert Earl Middleton, Lamont St., P?rford, failure to stop at a stop sign, court costs; Bobby Ray Jacobs, Rt. 1. Box 172, Raeford, operating a motorcycle without a safety helmet, court costs; Johnnie Ray Daniels, 212 S. Bethel Rd., Raeford, driving left of center, court costs; Samuel Mc Neill, Lumber Bridge, following too closely, costs; Ronnie D. Jacobs, Shannon, driving without a license, $25, costs; Paul Jackson, Rt. 1, Box 156 A, Raeford, no regis tration and failure to wear a safety helmet while operating a motor cycle, costs; Howard Melvin Garner, Robbins, inspection vio lation, costs; Ralpn Carlson Stanley, Fayetteville, passing vio lation, $5, costs. Sylvester Richardson, Lumber Bridge, was charged a $10 jail fee plus court costs for appearing intoxicated in a public olace. Ronald Cummins, Sclma, was fined $10 plus costs for fishing without a license. The magistrates also heard these worthless check charges: Robert D. Parker, Jr., Rt. 4, Box 213, Raeford, (three counts) $40 total restitution for Big Star plus court costs for each charge; Willie S. Locklear, P.O. Box 52, Shannon, $4.89 restutition for Dundarrach Store plus costs. beverage in the passenger area of a motor vehicle. The court recom mended that Bass be granted the privilege of the Work Release Program. He was also recommend ed for treatment for alcoholism. The state took a voluntary dismis sal on a charge apainst Bass for driving while his license was per manently revoked. Clinton Clark, Rt. 1, Box 64 G, Red Springs, pleaded guilty to the offense of uttering a forged check and was sentenced to not less than two nor more than four years in the State Department of Correction. The court recommended that Dark be considered for the Work Release Program. Waiving his right to assigned counsel, Billy Dean Allen, 17, Sandhill Youth Center, pleaded guilty to two counts of escape. He was sentenced to six months as a committed youthful offender for treatment and supervision. The sentence will begin at the expira tion of the sentence the defendant is now serving. Kenneth Helms, 18, Sandhill Youth Center, also waived his right to counsel and pleaded guihy to escape. He was sentenced to six months as a committed youthful offender with this sentence running concurrently with the sentence now being served. Timothy Barton, 17, Sandhill Youth Center, waived counsel and pleaded guilty to two counts of escape. He was sentenced to six months as a committed youthful offender with the sentence sche duled to begin at the expiration of the sentence now being served. Mrs. Hunter Forbes spent several days last week with her brother, Mr. and Mrs. Frank Tolar in Wilmington. Mrs. Tolar is a patient in a Wilmington hospital seriously ill. Mr. and Mrs. John E. Sumner of Fayetteville spent Sunday after noon with Mr. and Mrs. S.E. Sumner. Mrs. J. Edwin Clifton Jr., went to Moore Memorial Hospital last Tuesday for a check - up. She underwent surgery on her arm there several weeks ago. Miss Lina Chason is at Open Arms Rest Home and would be happy to have friends stop by for a visit. Mrs. Frank Williford is much better and able to be out. Visiting Mrs. James E. Osborne and family last Sunday were Mr. and Mrs. June Terry, Larry and Barry and Elisha and Mrs. Bettie Dean of Wendell. Mrs. Allene Barnhill of St. Pauls spent Sunday afternoon with them. Mrs. Jack Hamilton of Lumber ton, Mr. and Mrs. Alfreda Tolar and Mr. and Mrs. Stewart Tolar spent Sunday afternoon with their mother, Mrs. A.F. Tolar. Mrs. Ethel D. Gibson spent two week's with Mr. and Mrs. S.E. Sumner and Miss Pamela Sumner. Mrs. Gibson suffered with phle bitis. Visiting them during the week were Mr. and Mrs. M.S. Mrs. Hunter Forbes and week end guests enjoyed breakfast Sunday morning with Mr. and Mrs. Thomas McCall in Raeford.
