Washington, March . 16. Assistant Secretary of State Day, in reply to the statement issuing from the authorities of Spain that the presence of the fleet at Key West was a menace to the power of Spain in Cuba, uses vigorous language He says in reply to the question of what war preparations may mean that, Preparations were not begun until Spain bad tried to get a mar loan," and he has refused the request of Spain for thewith drawal of the fleet from Key West. Secretary of the Navy Long says that lie hopes so purchase from Chili the war ship O'Higgins. Secretary Long said today that the Maine court of inquiry will report Friday Saturday and to meet emergencies hicli will immediately follow the pub lication of the report, there will bo re. doubled activity in both the Army and Navy Departments. Senator Mason of Illinois who has bern most active in advocating the indepen- dence of Cuba, gives out the following signed statement in which he says: "Much, but not all, depends upon the report of the board of inquiry. The Maine'disaster is a separate matter. If it was an accident we ought not to ask money indemnity. If the vessel was blown up by outside influence we cannot in honor demand a cash indemnity. Leaving the Maine out, we have good and sufficient reasons for demanding the freedom of Cuba. The Spanish flag will be humiliated by yielding territory not to us but to the Cubans. There need be no war, for if the Maine incident is elimina- led Cuba will free herself if the United Stales grant her belligerent rights so she can trade with us, borrow money, enlist amen. Recognizing the independence of Cuba will solve the whole question Speaker Reed says that Congress will adjourn by the middle of April. Arrange ments are being made to that end. The appropriation bills are well under way, several being already passed. The edict is said to have gone forth that there will be no currency, river and harbor, or bankruptcy legislation, and there will be nothing for Congress to do after passing the appropriation bills if the Cuban question is sidetracked. Key Wrtt, March 10-(Speclal)-The nayal court of inquiry arrived early this morning on the Mangrove from Havana. The arrival of the court sent a thrill of excitement througn Key west. All is now expectation and suspence. No ex planation is given for the sudden return. The reticence of the court is absolute and the lnscrutible and grave faces of its members reveal only the shadow of the awful responsibility resting upon them The grave aspect of the court aggravates the general excitement felt over the re turn. The indications are that the report of the Naval board will go North within three days. Il is thought that perhaps partial statement will leave here for Washington tomorrow. The report of the board is sure to be straightforward, Atlanta, March 10 (Special) General Graham, commander of lbs Department of the South, newly organised with head' quarters at Atlanta, arrived in the city today. The addition of these vessels to the Spanish squadron in Cuban waters is viewed as almost amounting to an act of defiance, as they could not be used for any other purpose than in operating against battle ships or cruis ers. The President, it is stated on trust worthy information, is considering the advlsibillty of sending a flying squadron to meet the flotilla and keep watch on it. New Yohk, March 16 A Washington special to the Evening World says: "McKinley is seemingly weakening before the money power. The impression is growing that we are going to have peace if we have to crawl on our knees. The peace at any pi ice crowd has appar ently captured him and there is now uo happily ample reason to look for the fulfillment of deep rooted misgivings as to the form in which the President will intervene in Cuba. The utterance of Gen. Grosvcnor in which he says that there will be no war with Spain, since hi believes that Hpuin will make compensa tion it she is liable for disaster to Maine, is accepted as inspired." Journal Bureau, Raleiqh, N, C, March 10. f The Populists conference which has been called for touight is a puzzler, so far as any one's being able to tell what it proposes to do, One Republican who has taken part in fusion movements says that the plan is to make such propositions to the Democrats that they cannot possibly listen to, and then that Republican and Populist fusion will be made easier. Dr. J. Mott does not think thus of the Pop ulists. He believes they will make a fair proposition to the Democrats. All re mains uncertain as yet. The Supreme Court has now come to the help of Treasurer Worth in the oys ter claimants case. While its former decision was, that the State, and not the counties of Carteret and Pamlico, was liable for the claims about f 7,000. The court now Bays that the court costs do not constitute a part of the expense of the State government, so that treasurer Worth cannot be compelled to pay out of the money on hand, but that there must he a legislative appropriation for their payment. The Railroad commission yesterday heard the exceptions to the new passen- iter rates which a'e to go into effect March 22nd. The Seaboard was heard rst. The afternoon was devoted to hearing argument by the counsel for the different roads. Mr. Mowhorue, one of the directors of the Atlantic and North Carolina Railroad here yesterday. He opposes the lease of that road to the Southern, He filed papers to this effect with the Gov ernor and said the directors had appoint- ed Dr. Person of Wayne aiid himself to represent them in this mutter. Governor Russell yesterday granted two pardons. One was to Ldwin i llnnna, and the other to John S. Lyda, one from New Hanover county and the other fiom Henderson county. The farmers are now getting plenty of rain. It has been very badly needed, but there is a pretty good supply of steadily falling rain been given them. The Governor yesterday appointed Mr. Morrison Caldwell (Populist) of Concord penitentiary director to succeed Mr. Chadbourne, resigued. Mr. Chadbourne was a Republican. The State yesterday chartered the Gay Lumber Co." of Kinston with capi tal stock of $50,000. Today tlio signal corps of the State Guard began to be equipped by the mili tary authorities. The signal corps is at Concord. The report of the superintendent of the penitentiary, for 1897, John R. Smith was not submitted to the board by Chair. man Dockery. He says it may be ready to go in tomorrow. It is said that Chairman Caldwell the K. It. commission is in doubt now how the rate qmstion will be settled. In other words he is debating whether to stand by his former decision, or be dio tated to by Russell, who wants the old rates restored. It is thought that the recent decMon of the U. 8. Supreme court, known as the maximum rate case, may posdbly mean the abolishment of the railway commis sions. The Attorney-General's decision that Justices of the Peace, are liable for public road service, like other citizen affects many of them.
