Plaintiff, vs. Fred Young and wife, Mira Young, Champ Ray and wife, Grace Ray, Flaud Wilson and husband, Walter Wilson, Tee Y'oung and husband, Locke Voung, Ola Mae Young and husband, Clyde Young, Gertrude Ray, Brantley Ray and wife, Cora Ray, l.yda Kay, lslean Ray, Fred Ray, J. Under and by virtue of a judg ment of the Superior Court of Yancey County, North Carolina, the undersigned Commissioner will on the 28th day of April, 1945, at 11 o’clock A. M., at the Court house door in Burnsville, North Carolina, sell to the highest bidder for cash the entire interest in the First and second tracts hereinafter described, a 2i5 undivided interest in the Third tract hereinafter de scribed and a % undivided inter est in the Fourth and Fifth tracts hereinafter described. Said toacts of land are located and situate in Crabtree Township, Y'ancey Coun ty, North Carolina, and particular ly described as fellows: ' FIRST TRACT: Adjoining South Toe River, S. K. Ray, Fred Y'oung and others, described as follows: BEGINNING at a chestnut on top of a ridge, and known as the Southeast corner of the Wm. Thomas, Dave Hall tract, and runs West with said 'Thomas line 44 poles crossing a branch to the wagon road; thence South with the wagon road 48 poles to a buckeye; thence South 55 East 32 poles to a Maple; thence South 34 East 16 poles to a beech; same course 10 poies to a stake; thence East 40 poles to a stake on top of the ridge; thence a Southerly course with the top and main heighth of said ridge 50 poles to a stake in Silvers line at the South end of the old Tolley Bent field; thence Easterly with the Silvers • line to the Ainsworth line; thence South with the Ainsworth and 1 Silvers line to South Toe River; ' thence down said river with its various windings to the Abernathy Southeast corner of his mine tract; 1 thence South 45 West with his line 40 poles to a poplar; thence Nor therly with said Abernathy line about 4C poles to a chestnut on the ridge above the old store house; thence South 84 West with j the ridge 60 poles to a chestnut on top of the ridge; thence North 30 West with the top of the ridge 44 poles to a stake; thence Nortji with the ridge 16 poles to the BE GINNING, containing 125 acres be the same more or less. Being the same land that is described in the deed from B. S. Young and wife to A. P. Young, dated the 2nd day of January, 1892, and recorded in the office of Register of Deeds in Y'ancey County in Deed Book 24, page 220. SECOND TRACT: Aujoining John L. Young heirs, Fred Young and others, described as follows: BEGINNING on a white oak 011 a ridge standing in the East and West line of B. S. Young and David Thomas, and runs East 8 p iles to a stake; thence South 80 poles to the J. L. Young line; thence West with the J. L. Y’oung line to a stake at the Southeast comer of the Mcßee tract; thence North 80 poles to a stake; thence East to the BEGINNING, con taining 34 acres more or less.* Being the same lands that is de scribed in Deed from William Sil- j ver and wife to A. Y'oung, Coleman Robinson heirs and others describ ed as follows: BEGINNING on a stake at the mouth of a branch known as Wash Thomas place, corner between B S Young and Abernathy, and Pareson; thence down and with the river to a stake and a comer between B. S. Young and Phelts; thence vith Phelts hue to a stake in Coleman Robinson’s line; thence with top of ridge with said Rob inson line to W. A.
