Town of Murphy Cloe Moore, Mayor DRAFT RECOMMENDED FLOOD DAMAGE PREVENTION REQUIREMENTS FOR THE SUBDIVISION REGU LATIONS OF THE TOWN OF MURPHY, NORTH CAROLINA In order to prevent an increase in the flood damage potential of the Town of Murphy, the following requirement* are recommended for inclusion in the Town'* subdivision regulations. 1. Article 5 ? Definitions Add the following: 5.1.26 Flood. An overflow of lands not normally covered by water that results- in significant advene effects in the vicinity. 5.1.27 Floodway. The natural channel and the portion of the flood plain along the channel which must be retained solely for the passage of floodwaters to prevent an undue increase in flood heights upstream. For the purpose of these regulations, the floodway is further defined as follows: a. Within the corporate limits of the Town of Murphy, all land in the F-W District as shown on the map entitled, "Official Zoning Map of the Town of Murphy, North Carolina." b. Outside the corporate limits of the Town of Murphy, the floodway as shown on the map entitled, "Local Flood Studies, Murphy, N. C.," dated June 1960. Copies of the maps referred to above are on file at the Office of the Town Clerk and are available for public inspection. 5.1.28 Floodway Fringe Areas. Areas lying outside the Floodway District but within the area covered by the Regional Flood as defined in Section 5.1.29 of this article. 5.1.29 Regional Flood. A flood used in Tennessee Valley Authority flood studies, comparable to the largest floods known to have occurred on streams of similar physical characteristics in the same geographic region. For purposes of these regulations, the Regional Flood is further defined as foDows: Along the Hiwassee River the Regional Flood, (Regulated) as shown on the chart, "High Water Profiles, Hiwassee and Valley Rivers in the Vicinity of Murphy, North Carolina" (Tennessee Valley Authority, May 1961), which is made a part of these regulations. Along the Valley River the Regional Flood as shown on the chart, "High Water Profiles, Hiwassee and Valley Rivers in the Vicinity of Murphy, North Carolina" (Tennessee Valley Authority, May 1961), which is made a part of these regulations. 5.1.30 TVA Structure Profile. A profile established by the Tennessee Valley Authority on the basis of backwater curves which marks the lakeward limit of the land area on which buildings are permitted. 5.1.31 Land Subject to Flood. For the purpose of these regulations, land subject to flood shall be defined as follows: , a. Along the Hiwassee River land lying below the elevation of the Regional Flood (regulated) or the TVA Structure Profile (where applicable.) b. Along the Valley River land lying below the elevation of the Regional Flood or the TVA Structure Profile (where applicable). c. Along small streams and watercourses land within fifty (50) feet of the top of the banks. The Planning Board may allow a lesser distance, but not less than ten (10) feet, if in its judgment such a reduction will not create unduly hazardous conditions. 2. Article 8 - Sketch Plan and Plat Requirements Add the following: 8.2.16 If any portion of the land being subdivided is subject to flood as defined by these regulations, the limits of such land shall be shown. 8.3.12 If any protion of the land being subdivided is subject to flood as defined by these regulations, the limits of such land shall be shown. 3. Article 9 - Subdivision Design Standards Add the following: 9.1.13 Emergency Access. The street, pattern shall be designed so that in time of flood each lot in the subdivision shall be readily accessible to emergency vehicles. Drainage openings shall be designed so as not to restrict the flow of water and unduly increase flood height*. ' 9.4.4 Flood Free Building Site. Each lot in a subdivision shall contain a flood flee building site outside the limits of any setback or eawment lines that may be required by these regulations or any other applicable law or regulation. Except in floodways land may be filled to secure a flood flee site provided that such fill will not restrict the flow of water and unduly increase flood heights, and further provided that any fill shall extend twenty-five (25) feet beyond the limits of any building erected thereon.
