The Supreme Court of the United States has donned the robes of psychological and soci ological change in recent years. Thissweek, it put on the mantel of carpetbagger, holding that an 1866 law designed to give free slaves the right to own property applies this day and tiine to open housing. Thus, respect for law — and ultimately of order — was dealt another severe blow. For the time has come when law abiding citizens are just about the last concern of the supreme arbiters, and respect is natural ly dedining for nine men who wrench away the ritfits of one people to give them to another. This is discrimination of the very worst sort. In effect, the Supreme Court Tilling of Monday renders un necessary the so-called open housing law of 1966, which was to have gone info effect January 1, 1969. The new law applies only to public housing, and to sale and/or rentals by realtors or other public surveyors of of property. It provides specif ically that sale or rental of cer tain housing facilities cannot be denied on the basis if race. In the case of rentals, it provides that the non-discrkninatory clause applies only to agency administered facilities of more than five-family capacity. Now, the interpretation of the antiquated statute seemingly ap plies to privately, or individual ly owned housing. Which is to say, if you have a house for sale or rent, you have no choice in selection of purchaser or rent er, but must deal with whatever citizen who has the wherewith al to satisfy the financial stipu lations of the contract. The right to own, buy, sen, lease or rent property is a cher ished American privilege. It ought to apply equally to all citizens, regardless to race, creed, or national origin. But the right to own property should al so guarantee that the property owner may do what he wishes with his property, so long as it doesn’t deprive another person of his constitutional rights. When the Supreme Court rul ed that a private owner of prop erty has no choice in selecting a buyer or rentals it opened the way for abolition of all privacy — which is the very essence of democracy, and in truth is just about the only real difference between the democratic and so cialist or communist forms of government. In Russia, for in stance, the individual owns noth ing. All property is owned by the state, which stipulates who shall have the privilege of oc cupying it, in the case of hous ing. Here, individuals or corp orations own the property, but now the federal government de termines who must be privileg ed to buy or occupy it. The owner, then, has no voice what soever in the use or disposal of his real property. It would make as much sense to say: “Every American has a right to attend college,” and then to present yourself to Har vard University, however' quali fied you might be, and declare ‘Tin a citizen. You must per mit me to attend and to grad uate from Harvard.” “Wiho knows? That interpre tation may very well be the next one the carpetbaggers will sally forth With. The wisdom of our I fathers now becomes creating this great »‘of the people by misnomer) to pull up tgr the roots the flowers of democracy which have made fragrant and beautiful the privilege of being an American.
