This Is The Law What is real property? In a popular sense, property is anything that may be owned. It may be divided into two gen eral classes: real property and personal property. Real property is the term applied to land or real estate. It is property which is immov able and permanent in its char acter and use, such as houses and buildings, the annexed fix tures , the trees and vegetation above the soil as well as the mineral underneath its surface. What is personal property? Personal property is movable in its nature, and includes ev ery sort of property not pos sessing the nature of real prop- j erty, such as furniture, mer-£ chandise, clothing, animals, promissory notes, stocks and bonds, books, patents, automo biles, and the like. Personal property may be changed into real property, as where one takes brick and mor tar - all personal property - and constructs a house with them, which is then considered real property; and if in the lapse of time that s>>me house be razed to the ground and the building material sold as much, they again acquire the character istics of personal property. May one have "property right” in the dead body of ano ther? Yes. Although a dead body is not property in the strict sense, the right to its pos session and disposition is a quasi (or "as if’) property right which the courts will rec ognize and protect. In the absence of a pro vision in a person’s will, the right of preservation and burial belongs to the surviving hus band or wife, or next of kin. For example, if a man dies, it is his wife who has the say as to where and how the body is to be buried. If he has no surviving wife, then this right is vested in those next of kin to him. If there is a desecration of the grave of an ancestor, there vests in the next of kin as of the time the wrongful act is done a right to bring an ac tion for damages. Real property can only be conveyed or disposed of in ac cordance with the law of the place where it is situated, while a transfer of personal property is usually governed by the law of the place where the trans action occurs. Belonging to the Black Mountain Golf Club has been one of my most pleas* ant experiences during the more than twenty years I have lived here. I think the Black Mountain Golf Club is a great asset to Black Mountain. Its growth during the past few years has been phenomenal and its possibili ties are unlimited. As more and more tourists flock to our area, and since golf is now the largest participating sport in America, it is absolutely essen tial that the people of Black Mountain realize what an asset this Club is to our community. Because of our golf course hundreds of people visit our area every year who would otherwise go somewhere else _ and probably more clergymen play here than on any other course in the coun try. I hope our city fathers will give priority to not only containing the Club but to constantly improving it. Ross, you have done a marvelous job of managing this Club with a minimum amount of money to operate it. You are a great public relations asset to Black Mountain. The Rev. James Bryant and the Rev. Joe Holbert officiated. Graveside services were conducted Thursday afternoon in Olympia Cemetery, Columbia, S. C. Pallbearers were Douglas McPherson, Forest Owenby, Herman, J. and Howard Warren and Allen Brock. Mrs. Floyd was a native of Buncombe County. She lived in Columbia, prior to returning to Black Mountain in 1956. She made her home with a niece, Miss Alice Ownbey, and was a member of Southside Baptist Church in Columbia. Surviving are a sister, Mrs. Belle Parton of waynesville; and several other nieces and nephews. Harrison Funeral Home was in charge. Charles E. Brooks Last rites for C h a r 1 e s Arthur Brooks, 68, of Bee tree Road, Swannanoa, were held Wednesday afternoon, April 23, in the Bee Tree Baptist Church, of which he was a member. The Rev. Troy Lunsford and the Rev. Charles W. Smith of ficiated. Burial was in the church cemetery. Pallbearers were Jack Con nor, Jack and Jim Adams, Law rence Howie, Robert Schinkand Don Allison. Mr. Brooks had lived in Swan nanoa for 35 years. He was a former employee of Beacon Manufacturing Company. Surviving are two daughters, Mrs. Leonard LaPlante of Swannanoa and Mrs. William Padgett of Dearborn, Mich.; two sons, Charles of Wisconsin and Gerald Brooks of Dayton, Ohio; three sisters, and five brothers.
