Judge Parker said the Wiggins deed, going back to 1919 when deed was ob tained by the late M. G. Brown from the State Board of Education, covered only Juniper Swamp with no mention of Gallsberry. Wiggins had brought action against several surrounding property owners to get the boundary and ownership settled. Judge Parker allowed a non-suit against the defendants and said until further proof is supplied the State of North Carolina is still owner of Gallsberry. Wiggins, through his attorney, gave notice of appeal. Judge Parker was called to preside over the civil term of Superior Court here when illness in the family of Judge Howard H. Hubbard prevented him from coming from Clinton. The Wiggins matter was heard with out a jury on consent of the plaintiff and defendants.
