The X College was made the beneficiary of the trust. There was also a provis ion in the trust instrument re serving to Sam Scott a power of lustful look as adultry. THE YANCEY RECORD amendment. On August 5, 1963, Ben Bogart executed a will in which he be queathed $500,000 to the Inte grity Trust Company to be held as trustee “under the terms of a trust instrument dated Janu ary 10, 1960, executed by Sam Scott, and deposited with the Integrity Trust Company.” On April l, 1965, Scott deliver ed to the Integrity Trust Com pany a written instrument am ending the terms of the trust. Under the provisions of this amendment the Y College is made the beneficiary of the trust Bogert died on March 10, 1967. Which college is entitled to the income from the $1,500,000? Under a statute passed in 1955 by the General Assembly of Ncrth Carolina the Y College would be the beneficiary of the $1,500,000 trust fund. Unless the will provides oth erwise. the bequest of the SSOOXOO operates to dispose of property under the terms of the trust as they appear in writing at the time of the testator's death. The North Carolina statu te stipulates that the property bequeathed to the trustee of the existing trust shall not be deem ed held under a testamentary trust. The new law is not limited in its application to colleges. In fact, colleges are not even men tioned. The North Carolina statute simply permits a testator to add to the funds of a trust created in writing prior to his death. Thei exi-ting trust may be one that either he or another has set up. The fact that the existing trust is amendable or revocable is immaterial. The trust may be actually amended after the exe cution of the will, and the am endment need not be in the man ner required by the law of wills. •• • « May a person create a trust with himself as trustee and re serving to himself the income for life and the power to revoke cr amend the trust? Yes.
